GENERAL DESCRIPTION OF POSITION

Represents the City of Rogers in all legal matters before state and federal courts, to advise the Mayor and City Council on legal issues. Reviews, drafts, and edits any legal documents or pleadings as necessary. Provides leadership and strategy guidance to Public Safety Chiefs, Department Directors and high level employees within the City. Supervises the civil and criminal employees in the City's Legal Department. This position reports directly to the Mayor, and is supported by additional attorneys in the department. The incumbent provides strategic oversight of the City's most complex issues, making principled recommendations to senior employees on a regular basis. Experience with mentoring and influencing other leaders will be essential.

ESSENTIAL DUTIES AND RESPONSIBILITIES

Defend the City and all of it agencies in any lawsuits filed in state or federal court. Initiate and prosecute eminent domain complaints for land acquisition for the City. Prosecute misdemeanor criminal cases, as required, in Rogers District Court.

Supervise and monitor the prosecution of misdemeanor criminal cases in Rogers district Court by other Legal Department staff.

Conduct and supervise civil litigation including trial, depositions, and motions practice.

Advise on and review personnel issues for the City's HR Department, providing guidance on Policy and Training standards for all City Departments.

Review all contracts for any City Department, Agency, Board, or Commission. Draft and review legislation for the City Council's consideration.

Review, update, and improve the City's Code of Ordinances, identifying shortcomings in the City's current Code and policies to determine any compliance shortcomings.

Advise City Boards and Commissions and attend all meetings of the City Council, Planning Commission, Parks Advisory Committee, Historic District, and Airport Commission.

Ensure that the City is compliant with all federal and state laws regarding grant funding, employment, discrimination, and civil rights.

Monitor proposed state law changes and interact with local legislators to identify potential legislation adverse to the City's interests.

Assist City Departments in complying with state law regarding procurement for City projects and in the purchase and sale of real and personal property.

Assist in the negotiation and resolution of conflicts with local businesses and developers regarding zoning and/or land use conflicts.

Provides supervision and mentorship to attorneys and staff within the Legal Department.

All duties as required by Rogers Code of Ordinances Sec. 2-281, et seq; other duties as assigned by the Mayor and City Council.

SUPERVISORY RESPONSIBILITIES

RESPONSIBILITIES FOR WORK OF OTHERS

Supervises a MODERATE SIZE GROUP (8-15) of employees, but possibly smaller if difficult, SEMI-TECHNICAL work, requiring considerable direction and assistance, is involved. Plan, direct and coordinate work, make decisions, and perform personally the more difficult aspects of the same broad assignment.

RESPONSIBILITY FOR FUNDS, EQUIPMENT, PROPERTY, ETC.

REGULARLY responsible for funds, building premises, inventory, or other property owned, controlled, or leased by the organization and, in addition, may have temporary custody and responsibility of patron property, which through carelessness, error, loss, theft, misappropriation, or similar action would result in VERY important monetary losses to the organization. The total value for the above would range form $1,000,000 to $10,000,000.
